CEQA Streamlining for Infill Projects (SB 226)

OPR is pleased to announce that the Infill Streamlining updates to the CEQA Guidelines developed pursuant to SB 226 (Simitian, 2011) are now in effect. These additions to the CEQA Guidelines set forth a streamlined review process for infill projects. This update also contains the performance standards that will be used to determine an infill project’s eligibility for that streamlined review. The Office of Administrative Law transmitted the updates to the Secretary of State, and the new Guidelines went into effect immediately.

This updated Guidelines reflects input OPR and the Natural Resources Agency received during extensive public outreach since Governor Brown signed SB 226 in October 2011. That outreach effort included hundreds of individual meetings and conversations with stakeholders, presentations at numerous conferences, three public workshops, and two rounds of public review on OPR’s preliminary proposals.

To assist the review of the revised proposal package, OPR also prepared a Flow Chart and Presentation to illustrate the review process and application of performance standards for infill projects.  Please note, however, that these documents are not proposed to be included in the regulatory text of the CEQA Guidelines.
